Terms and Cancellation Policy — Luma × Raise the Barre Retreat

This Liability Waiver and Agreement ("Agreement") is entered into between Luma Pilates Ltd, operated by Lucia Poulter, and Raise the Barre, operated by Serena Crolla (together, the "Retreat Organisers", "we", "our"), and the participant completing this booking ("Participant", "you", "your"). By paying the deposit or full amount, you confirm that you have read, understood, and agreed to the terms below. Payment constitutes your binding acceptance of this Agreement.

Payment and deposits

All prices are quoted in GBP and are per person based on the room occupancy selected at the time of booking. Payment is made by bank transfer to the account details provided at checkout.

A non-refundable deposit of 25% per person is required to secure your place. If you choose the deposit plan, the following schedule applies:

If you choose to pay in full at the time of booking, the full amount is due immediately. Failure to pay any instalment by its due date may result in forfeiture of your place, and your deposit will not be refunded.

Cancellation by you

All cancellations must be made in writing to [email protected]. The cancellation takes effect from the date we receive your written notice. The following policy applies:

Your deposit is non-refundable in all circumstances. We strongly recommend taking out comprehensive travel insurance (see section 5) to cover the cost of cancellation due to illness, injury, or other unforeseen events.

No refunds will be issued for cancellations after full payment has been made, unless a replacement participant is found and approved by the Retreat Organisers.

Cancellation by the Retreat Organisers

In the unlikely event that the Retreat Organisers need to cancel the retreat, we will notify you as early as possible in writing. You will receive a full refund of all payments made to date, including the deposit.

Luma Pilates and Raise the Barre are not responsible for any additional costs you may have incurred, including flights, travel, or accommodation booked independently. This is another reason we strongly encourage comprehensive travel insurance.

Transferring your booking

You may transfer your booking to another person, subject to our prior written approval. To request a transfer, please contact us at [email protected] with the name and contact details of the person you wish to transfer to. We reserve the right to decline any transfer request.

Room type changes are not permitted after a booking is confirmed. If you wish to change your room, you must cancel your existing booking (subject to the cancellation terms above) and make a new booking, subject to availability.

Travel and insurance

You are solely responsible for arranging travel to and from the retreat venue in Portugal. Comprehensive travel insurance is required for all participants and must be in place before the retreat begins. Your policy must cover, as a minimum:

Cancellation and curtailment  ·  Medical expenses and repatriation  ·  Personal liability  ·  Loss or damage to personal belongings

By confirming your booking you agree that you hold, or will hold before the retreat begins, a valid policy meeting these requirements. Luma Pilates and Raise the Barre accept no liability for any loss or expense incurred as a result of a failure to hold adequate insurance.

Health and fitness acknowledgement

You confirm that you are in good physical health and capable of participating in Reformer Pilates and Barre classes. You agree to disclose any relevant medical conditions, injuries, or concerns to the lead instructor prior to or at the start of the retreat.

You acknowledge that participation in physical activities carries inherent risks, including but not limited to slips, falls, muscle strains, or other injuries. You understand that participation is voluntary, and you may choose not to take part in any activity.

If your health circumstances change between booking and the retreat, it is your responsibility to notify us at [email protected] if this affects your ability to participate. The Retreat Organisers reserve the right to exclude any participant from an activity where, in the reasonable judgement of the relevant instructor, participation would pose a risk to their health or safety or that of others.

Assumption of risk and liability

By paying the deposit, you accept full responsibility for any and all risks, injuries, or damages (known or unknown) that may occur as a result of:

Participation in Reformer Pilates classes led by Lucia Poulter
Participation in Barre classes led by Serena Crolla
Use of retreat facilities, including Reformer machines, studio spaces, and outdoor areas
Travel to and from the retreat venue
Any other activities forming part of the retreat programme

You hereby release Luma Pilates Ltd, Lucia Poulter, Raise the Barre, Serena Crolla, the venue and its owners, staff, and any associated contractors from all liability for any injury, illness, accident, property loss, or damage sustained during or after the retreat, except where such liability cannot be excluded by law.

Food and dietary requirements

Meals will be provided as part of the retreat programme. You must notify the Retreat Organisers of any dietary requirements or allergies at the time of booking or as soon as they become known.

While reasonable efforts will be made to accommodate dietary needs, the Retreat Organisers cannot guarantee a completely allergen-free environment.

Accommodation and conduct

Accommodation will be provided at the retreat venue. Participants are expected to behave respectfully towards staff, instructors, fellow guests, and property at all times.

The Retreat Organisers reserve the right to remove any participant whose behaviour is deemed disruptive, unsafe, or inappropriate, without refund.

Force majeure

Luma Pilates and Raise the Barre shall not be held liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, strikes, pandemics, travel restrictions, or government regulations.

In such cases, deposits and payments may be transferred to a rescheduled retreat at our discretion, but refunds will not be guaranteed beyond the obligations set out in section 03.

Photography and media

By attending the retreat, you consent to being photographed or filmed for promotional purposes, including use on Luma Pilates' and Raise the Barre's websites and social media channels, unless you notify us in writing prior to the retreat.

Governing law

This Agreement shall be governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
